(a) It shall be unlawful for any person owning or having under his control any animal, to permit such animal upon the beach or an approach, except service animals as defined by Florida Statutes and the Americans with Disabilities Act shall be allowed on the beach at all times.
(b) From the northern boundary of the right-of-way of Rockefeller Drive to the southern boundary of Milsap Road, as well as from the northern boundary of the right-of-way of Williams Avenue to the southern boundary of Seabreeze Boulevard, dogs, as defined by section 14-31 of the Code of Ordinances, are permitted on these portions of the beach or an approach subject to the following regulations:
(1) Dogs are only allowed on the beach or on an approach from sunrise to sunset. Violation of this paragraph (b)(1) shall be enforced and punishable pursuant to section 20-111;
(2) All persons must have direct control of a dog by immediate and continuous physical control by means of a leash not to exceed six feet in length and of sufficient strength to restrain said dog;
(3) All persons owning or having control of a dog must pick up all feces generated by the dog;
(4) All persons owning or having control of a dog must ensure the dog does not intentionally harm or harass any wildlife;
(5) All persons owning or having control of a dog must ensure the dog does not disturb or damage the dune or the native stabilizing vegetation of the dune system;
(6) All persons owning or having control of a dog must have a current rabies vaccination and be able to present proof of such vaccination for the dog in compliance with section 14-44 of the Code;
(7) County council may, by resolution, require payment of a reasonable fee including presentation of proof of such payment, for a dog to access these portions of the beach;
(8) All persons must obey those conspicuously posted county rules governing dogs on the beach. A violation of those rules is a violation of this subsection;
(9) Unless otherwise provided in this subsection, violations of this subsection (b) shall be enforced in the same manner as chapter 14 of the Code of Ordinances, including penalties as provided in section 14-32;
(10) Notwithstanding anything in this Code to the contrary, provisions of the animal control code, article II, of chapter 14, of the Code of Ordinances, including violations thereof, which are not in conflict with chapter 20, beach code, are incorporated into this subsection (b) and may be enforced in the same manner.
